Privacy Concerns Around "Social Reading"

Interesting paper: “The Perils of Social Reading,” by Neil M. Richards, from the Georgetown Law Journal.

Abstract: Our law currently treats records of our reading habits under two contradictory rules ­ rules mandating confidentiality, and rules permitting disclosure. Recently, the rise of the social Internet has created more of these records and more pressures on when and how they should be shared. Companies like Facebook, in collaboration with many newspapers, have ushered in the era of “social reading,” in which what we read may be “frictionlessly shared” with our friends and acquaintances. Disclosure and sharing are on the rise.

This Article sounds a cautionary note about social reading and frictionless sharing. Social reading can be good, but the ways in which we set up the defaults for sharing matter a great deal. Our reader records implicate our intellectual privacy ­ the protection of reading from surveillance and interference so that we can read freely, widely, and without inhibition. I argue that the choices we make about how to share have real consequences, and that “frictionless sharing” is not frictionless, nor it is really sharing. Although sharing is important, the sharing of our reading habits is special. Such sharing should be conscious and only occur after meaningful notice.

The stakes in this debate are immense. We are quite literally rewiring the public and private spheres for a new century. Choices we make now about the boundaries between our individual and social selves, between consumers and companies, between citizens and the state, will have unforeseeable ramifications for the societies our children and grandchildren inherit. We should make choices that preserve our intellectual privacy, not destroy it. This Article suggests practical ways to do just that.

Teenagers and Privacy

Good article debunking the myth that young people don’t care about privacy on the Intenet.

Most kids are well aware of risks, and make “fairly sophisticated” decisions about privacy settings based on advice and information from their parents, teachers, and friends. They differentiate between people they don’t know out in the world (distant strangers) and those they don’t know in the community, such as high school students in their hometown (near strangers). Marisa, for example, a 10-year-old interviewed in the study (who technically is not allowed to use Facebook), “enjoys participating in virtual worlds and using instant messenger and Facebook to socialize with her friends”; is keenly aware of the risks—especially those related to privacy; and she doesn’t share highly sensitive personal information on her Facebook profile and actively blocks certain people.

Rather than fearing the unknown stranger, young adults are more wary of the “known other”—parents, school teachers, classmates, etc.—for fear of “the potential for the known others to share embarrassing information about them”; 83 percent of the sample group cited at least one known other they wanted to maintain their privacy from; 71 percent cited at least one known adult. Strikingly, seven out of the 10 participants who reported an incident when their privacy was breached said it was “perpetrated by known others.”

Password Sharing Among American Teenagers

Interesting article from the New York Times on password sharing as a show of affection.

“It’s a sign of trust,” Tiffany Carandang, a high school senior in San Francisco, said of the decision she and her boyfriend made several months ago to share passwords for e-mail and Facebook. “I have nothing to hide from him, and he has nothing to hide from me.”

“That is so cute,” said Cherry Ng, 16, listening in to her friend’s comments to a reporter outside school. “They really trust each other.”

We do, said Ms. Carandang, 17. “I know he’d never do anything to hurt my reputation,” she added.

It doesn’t always end so well, of course. Changing a password is simple, but students, counselors and parents say that damage is often done before a password is changed, or that the sharing of online lives can be the reason a relationship falters.

Ethnologist danah boyd discusses what’s happening:

For Meixing, sharing her password with her boyfriend is a way of being connected. But it’s precisely these kinds of narratives that have prompted all sorts of horror by adults over the last week since that NYTimes article came out. I can’t count the number of people who have gasped “How could they!?!” at me. For this reason, I feel the need to pick up on an issue that the NYTimes let out.

The idea of teens sharing passwords didn’t come out of thin air. In fact, it was normalized by adults. And not just any adult. This practice is the product of parental online safety norms. In most households, it’s quite common for young children to give their parents their passwords. With elementary and middle school youth, this is often a practical matter: children lose their passwords pretty quickly. Furthermore, most parents reasonably believe that young children should be supervised online. As tweens turn into teens, the narrative shifts. Some parents continue to require passwords be forked over, using explanations like “because I’m your mother.” But many parents use the language of “trust” to explain why teens should share their passwords with them.

Underage Children on Facebook

Interesting research on how parents help their children lie about their age to get onto Facebook.

One reaction to our data might be that companies should not be allowed to restrict access to children on their sites. Unfortunately, getting the parental permission required by COPPA is technologically difficult, financially costly, and ethically problematic. Sites that target children take on this challenge, but often by excluding children whose parents lack resources to pay for the service, those who lack credit cards, and those who refuse to provide extra data about their children in order to offer permission. The situation is even more complicated for children who are in abusive households, have absentee parents, or regularly experience shifts in guardianship. General-purpose sites, including communication platforms like Gmail and Skype and social media services like Facebook and Twitter, generally prefer to avoid the social, technical, economic, and free speech complications involved.

While there is merit to thinking about how to strengthen parent permission structures, focusing on this obscures the issues that COPPA is intended to address: data privacy and online safety. COPPA predates the rise of social media. Its architects never imagined a world where people would share massive quantities of data as a central part of participation. It no longer makes sense to focus on how data are collected; we must instead question how those data are used. Furthermore, while children may be an especially vulnerable population, they are not the only vulnerable population. Most adults have little sense of how their data are being stored, shared, and sold.

COPPA is a well-intentioned piece of legislation with unintended consequences for parents, educators, and the public writ large. It has stifled innovation for sites focused on children and its implementations have made parenting more challenging. Our data clearly show that parents are concerned about privacy and online safety. Many want the government to help, but they don’t want solutions that unintentionally restrict their children’s access. Instead, they want guidance and recommendations to help them make informed decisions. Parents often want their children to learn how to be responsible digital citizens. Allowing them access is often the first step.

Facebook Patent to Track Users Even When They are Not Logged In to Facebook

Patent application number 2011/023240:

Communicating Information in a Social Network System about Activities from Another Domain

Abstract: In one embodiment, a method is described for tracking information about the activities of users of a social networking system while on another domain. The method includes maintaining a profile for each of one or more users of the social networking system, each profile identifying a connection to one or more other users of the social networking system and including information about the user. The method additionally includes receiving one or more communications from a third-party website having a different domain than the social network system, each message communicating an action taken by a user of the social networking system on the thirdparty website. The method additionally includes logging the actions taken on the third-party website in the social networking system, each logged action including information about the action. The method further includes correlating the logged actions with one or more advertisements presented to the one or more users on the third-party website as well as correlating the logged actions with a user of the social networking system.

Facebook denies that this is a patent for that. Although Facebook does seem to track users even when they are not logged in, as well as people who aren’t even Facebook users.

EDITED TO ADD (10/24): Facebook claims that, while they do collect information on non-users, they don’t use it for profiling. This feels like hair-splitting to me; I get emails from Facebook with lists of friends who are already on the site.

Discovering What Facebook Knows About You

Things are getting interesting in Europe:

Max is a 24 year old law student from Vienna with a flair for the interview and plenty of smarts about both technology and legal issues. In Europe there is a requirement that entities with data about individuals make it available to them if they request it. That’s how Max ended up with a personalized CD from Facebook that he printed out on a stack of paper more than a thousand pages thick (see image below). Analysing it, he came to the conclusion that Facebook is engineered to break many of the requirements of European data protection. …

The logical next step was a series of 22 lucid and well-reasoned complaints that he submitted to the Irish Data Protection Commissioner (Facebook states that European users have a relationship with the Irish Facebook subsidiary).
