Nobody Encrypts their Phone Calls

From the Forbes blog:

In an annual report published Friday by the U.S. judicial system on the number of wiretaps it granted over the past year …, the courts revealed that there were 2,376 wiretaps by law enforcement agencies in 2009, up 26% from 1,891 the year before, and up 76% from 1999. (Those numbers, it should be noted, don’t include international wiretaps or those aimed at intelligence purposes rather than law enforcement.)

But in the midst of that wiretapping bonanza, a more surprising figure is the number of cases in which law enforcement encountered encryption as a barrier: one.

According to the courts, only one wiretapping case in the entire country encountered encryption last year, and in that single case, whatever privacy tools were used don’t seemed to have posed much of a hurdle to eavesdroppers. “In 2009, encryption was encountered during one state wiretap, but did not prevent officials from obtaining the plain text of the communications,” reads the report.

Preventing Terrorist Attacks in Crowded Areas

On the New York Times Room for Debate Blog, I—along with several other people—was asked about how to prevent terrorist attacks in crowded areas. This is my response.

In the wake of Saturday’s failed Times Square car bombing, it’s natural to ask how we can prevent this sort of thing from happening again. The answer is stop focusing on the specifics of what actually happened, and instead think about the threat in general.

Think about the security measures commonly proposed. Cameras won’t help. They don’t prevent terrorist attacks, and their forensic value after the fact is minimal. In the Times Square case, surely there’s enough other evidence—the car’s identification number, the auto body shop the stolen license plates came from, the name of the fertilizer store—to identify the guy. We will almost certainly not need the camera footage. The images released so far, like the images in so many other terrorist attacks, may make for exciting television, but their value to law enforcement officers is limited.

Check points won’t help, either. You can’t check everybody and everything. There are too many people to check, and too many train stations, buses, theaters, department stores and other places where people congregate. Patrolling guards, bomb-sniffing dogs, chemical and biological weapons detectors: they all suffer from similar problems. In general, focusing on specific tactics or defending specific targets doesn’t make sense. They’re inflexible; possibly effective if you guess the plot correctly, but completely ineffective if you don’t. At best, the countermeasures just force the terrorists to make minor changes in their tactic and target.

It’s much smarter to spend our limited counterterrorism resources on measures that don’t focus on the specific. It’s more efficient to spend money on investigating and stopping terrorist attacks before they happen, and responding effectively to any that occur. This approach works because it’s flexible and adaptive; it’s effective regardless of what the bad guys are planning for next time.

After the Christmas Day airplane bombing attempt, I was asked how we can better protect our airplanes from terrorist attacks. I pointed out that the event was a security success—the plane landed safely, nobody was hurt, a terrorist was in custody—and that the next attack would probably have nothing to do with explosive underwear. After the Moscow subway bombing, I wrote that overly specific security countermeasures like subway cameras and sensors were a waste of money.

Now we have a failed car bombing in Times Square. We can’t protect against the next imagined movie-plot threat. Isn’t it time to recognize that the bad guys are flexible and adaptive, and that we need the same quality in our countermeasures?

I know, nothing I haven’t said many times before.

Seat Belt Use and Lessons for Security Awareness

In January of this year the National Highway Traffic Safety Administration released a report called “Analyzing the First Years Of the Ticket or Click It Mobilizations“… While the report is focused on the use of seat belts, it has fascinating applications to the world of security awareness. The report focuses on 2000 – 2006, when most states in the United States began campaigns (called Ticket or Click-It) promoting and requiring the use of seat belts. Just like security awareness, the goal of the campaign was to change behaviors, specifically to get people to wear their seat belts when driving… The campaigns were very successful, resulting in a 20-23% increase in seat belt use regardless of which statistics they used. The key finding of the report was that enforcement and not money spent on media were key to results. The states that had the strongest enforcement had the most people using seat belts. The states with the weakest enforcement had the lowest seat belt usage.

I feel the key lesson here is not only must an awareness program effectively communicate, but to truly change behaviors what you communicate has to be enforced. An information security awareness campaign communicates what is enforced (your policies) and in addition it should communicate why. Then, follow-up that campaign with strong, visible enforcement.

New York Police Protect Obama from Bicycles

They were afraid that they might contain pipe bombs.

This is the correct reaction:

In any case, I suspect someone somewhere just panicked at the possibility that something might explode near the President on his watch, since the whole operation has the finesse of a teenage stoner shoving his pot paraphernalia under the bed and desperately trying to clear the air with a copy of “Maxim” when he hears his parents coming home.

Seems that it’s legal:

When asked by Gothamist, their precinct contact replied: “No, they just did this because the president was coming and they didn’t want anything on the sidewalks. You’re not supposed to lock you bike to signposts anyway, they have those new bike racks you’re supposed to use.”

I’ll bet you anything that they didn’t leave the bicycles that were locked to the racks.

Guide to Microsoft Police Forensic Services

The “Microsoft Online Services Global Criminal Compliance Handbook (U.S. Domestic Version)” (also can be found here, here, and here) outlines exactly what Microsoft will do upon police request. Here’s a good summary of what’s in it:

The Global Criminal Compliance Handbook is a quasi-comprehensive explanatory document meant for law enforcement officials seeking access to Microsoft’s stored user information. It also provides sample language for subpoenas and diagrams on how to understand server logs.

I call it “quasi-comprehensive” because, at a mere 22 pages, it doesn’t explore the nitty-gritty of Microsoft’s systems; it’s more like a data-hunting guide for dummies.

When it was first leaked, Microsoft tried to scrub it from the Internet. But they quickly realized that it was futile and relented.

Eating a Flash Drive

How not to destroy evidence:

In a bold and bizarre attempt to destroy evidence seized during a federal raid, a New York City man grabbed a flash drive and swallowed the data storage device while in the custody of Secret Service agents, records show.

The article wasn’t explicit about this—odd, as it’s the main question any reader would have—but it seems that the man’s digestive tract did not destroy the evidence.

More Surveillance in the UK

This seems like a bad idea:

Police in the UK are planning to use unmanned spy drones, controversially deployed in Afghanistan, for the “routine” monitoring of antisocial motorists, protesters, agricultural thieves and fly-tippers, in a significant expansion of covert state surveillance.

Once again, laws and technologies deployed against terrorism are used against much more mundane crimes.

Sprint Provides U.S. Law Enforcement with Cell Phone Customer Location Data

Wired summarizes research by Christopher Soghoian:

Sprint Nextel provided law enforcement agencies with customer location data more than 8 million times between September 2008 and October 2009, according to a company manager who disclosed the statistic at a non-public interception and wiretapping conference in October.

The manager also revealed the existence of a previously undisclosed web portal that Sprint provides law enforcement to conduct automated “pings” to track users. Through the website, authorized agents can type in a mobile phone number and obtain global positioning system (GPS) coordinates of the phone.

From Soghoian’s blog:

Sprint Nextel provided law enforcement agencies with its customers’ (GPS) location information over 8 million times between September 2008 and October 2009. This massive disclosure of sensitive customer information was made possible due to the roll-out by Sprint of a new, special web portal for law enforcement officers.

The evidence documenting this surveillance program comes in the form of an audio recording of Sprint’s Manager of Electronic Surveillance, who described it during a panel discussion at a wiretapping and interception industry conference, held in Washington DC in October of 2009.

It is unclear if Federal law enforcement agencies’ extensive collection of geolocation data should have been disclosed to Congress pursuant to a 1999 law that requires the publication of certain surveillance statistics—since the Department of Justice simply ignores the law, and has not provided the legally mandated reports to Congress since 2004.

Sprint denies this; details in the Wired article. The odds of us ever learning the truth are probably very low.

Denial-of-Service Attack Against CALEA

Interesting:

The researchers say they’ve found a vulnerability in U.S. law enforcement wiretaps, if only theoretical, that would allow a surveillance target to thwart the authorities by launching what amounts to a denial-of-service (DoS) attack against the connection between the phone company switches and law enforcement.

The University of Pennsylvania researchers found the flaw after examining the telecommunication industry standard ANSI Standard J-STD-025, which addresses the transmission of wiretapped data from telecom switches to authorities, according to IDG News Service. Under the 1994 Communications Assistance for Law Enforcement Act, or Calea, telecoms are required to design their network architecture to make it easy for authorities to tap calls transmitted over digitally switched phone networks.

But the researchers, who describe their findings in a paper, found that the standard allows for very little bandwidth for the transmission of data about phone calls, which can be overwhelmed in a DoS attack. When a wiretap is enabled, the phone company’s switch establishes a 64-Kbps Call Data Channel to send data about the call to law enforcement. That paltry channel can be flooded if a target of the wiretap sends dozens of simultaneous SMS messages or makes numerous VOIP phone calls “without significant degradation of service to the targets’ actual traffic.”

As a result, the researchers say, law enforcement could lose records of whom a target called and when. The attack could also prevent the content of calls from being accurately monitored or recorded.
