Privacy Policies: Perception vs. Reality

New paper: “What Californians Understand About Privacy Online,” by Chris Jay Hoofnagle and Jennifer King. From the abstract:

A gulf exists between California consumers’ understanding of online rules and common business practices. For instance, Californians who shop online believe that privacy policies prohibit third-party information sharing. A majority of Californians believes that privacy policies create the right to require a website to delete personal information upon request, a general right to sue for damages, a right to be informed of security breaches, a right to assistance if identity theft occurs, and a right to access and correct data.

These findings show that California consumers overvalue the mere fact that a website has a privacy policy, and assume that websites carrying the label have strong, default rules to protect personal data. In a way, consumers interpret “privacy policy” as a quality seal that denotes adherence to some set of standards. Website operators have little incentive to correct this misperception, thus limiting the ability of the market to produce outcomes consistent with consumers’ expectations. Drawing upon earlier work, we conclude that because the term “privacy policy” has taken on a specific meaning in the minds of consumers, its use should be limited to contexts where businesses provide a set of protections that meet consumers’ expectations.

Cyberattack Against Georgia Preceded Real Attack

This is interesting:

Exactly who was behind the cyberattack is not known. The Georgian government blamed Russia for the attacks, but the Russian government said it was not involved. In the end, Georgia, with a population of just 4.6 million and a relative latecomer to the Internet, saw little effect beyond inaccessibility to many of its government Web sites, which limited the government’s ability to spread its message online and to connect with sympathizers around the world during the fighting with Russia.

In Georgia, media, communications and transportation companies were also attacked, according to security researchers. Shadowserver saw the attack against Georgia spread to computers throughout the government after Russian troops entered the Georgian province of South Ossetia. The National Bank of Georgia’s Web site was defaced at one point. Images of 20th-century dictators as well as an image of Georgia’s president, Mr. Saakashvili, were placed on the site. “Could this somehow be indirect Russian action? Yes, but considering Russia is past playing nice and uses real bombs, they could have attacked more strategic targets or eliminated the infrastructure kinetically,” said Gadi Evron, an Israeli network security expert. “The nature of what’s going on isn’t clear,” he said.

In addition to D.D.O.S. attacks that crippled Georgia’s limited Internet infrastructure, researchers said there was evidence of redirection of Internet traffic through Russian telecommunications firms beginning last weekend. The attacks continued on Tuesday, controlled by software programs that were located in hosting centers controlled by a Russian telecommunications firms. A Russian-language Web site, stopgeorgia.ru, also continued to operate and offer software for download used for D.D.O.S. attacks.

Welcome to 21st century warfare.

“It costs about 4 cents per machine,” Mr. Woodcock said. “You could fund an entire cyberwarfare campaign for the cost of replacing a tank tread, so you would be foolish not to.”

Man-in-the-Middle Attacks

Last week’s dramatic rescue of 15 hostages held by the guerrilla organization FARC was the result of months of intricate deception on the part of the Colombian government. At the center was a classic man-in-the-middle attack.

In a man-in-the-middle attack, the attacker inserts himself between two communicating parties. Both believe they’re talking to each other, and the attacker can delete or modify the communications at will.

The Wall Street Journal reported how this gambit played out in Colombia:

“The plan had a chance of working because, for months, in an operation one army officer likened to a ‘broken telephone,’ military intelligence had been able to convince Ms. Betancourt’s captor, Gerardo Aguilar, a guerrilla known as ‘Cesar,’ that he was communicating with his top bosses in the guerrillas’ seven-man secretariat. Army intelligence convinced top guerrilla leaders that they were talking to Cesar. In reality, both were talking to army intelligence.”

This ploy worked because Cesar and his guerrilla bosses didn’t know one another well. They didn’t recognize one anothers’ voices, and didn’t have a friendship or shared history that could have tipped them off about the ruse. Man-in-the-middle is defeated by context, and the FARC guerrillas didn’t have any.

And that’s why man-in-the-middle, abbreviated MITM in the computer-security community, is such a problem online: Internet communication is often stripped of any context. There’s no way to recognize someone’s face. There’s no way to recognize someone’s voice. When you receive an e-mail purporting to come from a person or organization, you have no idea who actually sent it. When you visit a website, you have no idea if you’re really visiting that website. We all like to pretend that we know who we’re communicating with—and for the most part, of course, there isn’t any attacker inserting himself into our communications—but in reality, we don’t. And there are lots of hacker tools that exploit this unjustified trust, and implement MITM attacks.

Even with context, it’s still possible for MITM to fool both sides—because electronic communications are often intermittent. Imagine that one of the FARC guerrillas became suspicious about who he was talking to. So he asks a question about their shared history as a test: “What did we have for dinner that time last year?” or something like that. On the telephone, the attacker wouldn’t be able to answer quickly, so his ruse would be discovered. But e-mail conversation isn’t synchronous. The attacker could simply pass that question through to the other end of the communications, and when he got the answer back, he would be able to reply.

This is the way MITM attacks work against web-based financial systems. A bank demands authentication from the user: a password, a one-time code from a token or whatever. The attacker sitting in the middle receives the request from the bank and passes it to the user. The user responds to the attacker, who passes that response to the bank. Now the bank assumes it is talking to the legitimate user, and the attacker is free to send transactions directly to the bank. This kind of attack completely bypasses any two-factor authentication mechanisms, and is becoming a more popular identity-theft tactic.

There are cryptographic solutions to MITM attacks, and there are secure web protocols that implement them. Many of them require shared secrets, though, making them useful only in situations where people already know and trust one another.

The NSA-designed STU-III and STE secure telephones solve the MITM problem by embedding the identity of each phone together with its key. (The NSA creates all keys and is trusted by everyone, so this works.) When two phones talk to each other securely, they exchange keys and display the other phone’s identity on a screen. Because the phone is in a secure location, the user now knows who he is talking to, and if the phone displays another organization—as it would if there were a MITM attack in progress—he should hang up.

Zfone, a secure VoIP system, protects against MITM attacks with a short authentication string. After two Zfone terminals exchange keys, both computers display a four-character string. The users are supposed to manually verify that both strings are the same—”my screen says 5C19; what does yours say?”—to ensure that the phones are communicating directly with each other and not with an MITM. The AT&T TSD-3600 worked similarly.

This sort of protection is embedded in SSL, although no one uses it. As it is normally used, SSL provides an encrypted communications link to whoever is at the other end: bank and phishing site alike. And the better phishing sites create valid SSL connections, so as to more effectively fool users. But if the user wanted to, he could manually check the SSL certificate to see if it was issued to “National Bank of Trustworthiness” or “Two Guys With a Computer in Nigeria.”

No one does, though, because you have to both remember and be willing to do the work. (The browsers could make this easier if they wanted to, but they don’t seem to want to.) In the real world, you can easily tell a branch of your bank from a money changer on a street corner. But on the internet, a phishing site can be easily made to look like your bank’s legitimate website. Any method of telling the two apart takes work. And that’s the first step to fooling you with a MITM attack.

Man-in-the-middle isn’t new, and it doesn’t have to be technological. But the internet makes the attacks easier and more powerful, and that’s not going to change anytime soon.

Browser Insecurity

This excellent paper measures insecurity in the global population of browsers, using Google’s web server logs. Why is this important? Because browsers are an increasingly popular attack vector.

The results aren’t good.

…at least 45.2%, or 637 million users, were not using the most secure Web browser version on any working day from January 2007 to June 2008. These browsers are an easy target for drive-by download attacks as they are potentially vulnerable to known exploits.

That number breaks down as 577 million users of Internet Explorer, 38 million of Firefox, 17 million of Safari, and 5 million of Opera. Lots more detail in the paper, including some ideas for technical solutions.

Oklahoma Data Leak

Usually I don’t bother blogging about these, but this one is particularly bad. Anyone with basic SQL knowledge could have registered anyone he wanted as a sex offender.

One of the cardinal rules of computer programming is to never trust your input. This holds especially true when your input comes from users, and even more so when it comes from the anonymous, general public. Apparently, the developers at Oklahoma’s Department of Corrections slept through that day in computer science class, and even managed to skip all of Common Sense 101. You see, not only did they trust anonymous user input on their public-facing website, but they blindly executed it and displayed whatever came back.

The result of this negligently bad coding has some rather serious consequences: the names, addresses, and social security numbers of tens of thousands of Oklahoma residents were made available to the general public for a period of at least three years. Up until yesterday, April 13 2008, anyone with a web browser and the knowledge from Chapter One of SQL For Dummies could have easily accessed—and possibly, changed—any data within the DOC’s databases. It took me all of a minute to figure out how to download 10,597 records—SSNs and all—from their website.

Web Entrapment

Frightening sting operation by the FBI. They posted links to supposed child porn videos on boards frequented by those types, and obtained search warrants based on access attempts.

This seems like incredibly flimsy evidence. Someone could post the link as an embedded image, or send out e-mail with the link embedded, and completely mess with the FBI’s data—and the poor innocents’ lives. Such are the problems when the mere clicking on a link is justification for a warrant.

Third Parties Controlling Information

Wine Therapy is a web bulletin board for serious wine geeks. It’s been active since 2000, and its database of back posts and comments is a wealth of information: tasting notes, restaurant recommendations, stories and so on. Late last year someone hacked the board software, got administrative privileges and deleted the database. There was no backup.

Of course the board’s owner should have been making backups all along, but he has been very sick for the past year and wasn’t able to. And the Internet Archive has been only somewhat helpful.

More and more, information we rely on—either created by us or by others—is out of our control. It’s out there on the internet, on someone else’s website and being cared for by someone else. We use those websites, sometimes daily, and don’t even think about their reliability.

Bits and pieces of the web disappear all the time. It’s called “link rot,” and we’re all used to it. A friend saved 65 links in 1999 when he planned a trip to Tuscany; only half of them still work today. In my own blog, essays and news articles and websites that I link to regularly disappear—sometimes within a few days of my linking to them.

It may be because of a site’s policies—some newspapers only have a couple of weeks on their website—or it may be more random: Position papers disappear off a politician’s website after he changes his mind on an issue, corporate literature disappears from the company’s website after an embarrassment, etc. The ultimate link rot is “site death,” where entire websites disappear: Olympic and World Cup events after the games are over, political candidates’ websites after the elections are over, corporate websites after the funding runs out and so on.

Mostly, we ignore the issue. Sometimes I save a copy of a good recipe I find, or an article relevant to my research, but mostly I trust that whatever I want will be there next time. Were I planning a trip to Tuscany, I would rather search for relevant articles today than rely on a nine-year-old list anyway. Most of the time, link rot and site death aren’t really a problem.

This is changing in a Web 2.0 world, with websites that are less about information and more about community. We help build these sites, with our posts or our comments. We visit them regularly and get to know others who also visit regularly. They become part of our socialization on the internet and the loss of them affects us differently, as Greatest Journal users discovered in January when their site died.

Few, if any, of the people who made Wine Therapy their home kept backup copies of their own posts and comments. I’m sure they didn’t even think of it. I don’t think of it, when I post to the various boards and blogs and forums I frequent. Of course I know better, but I think of these forums as extensions of my own computer—until they disappear.

As we rely on others to maintain our writings and our relationships, we lose control over their availability. Of course, we also lose control over their security, as MySpace users learned last month when a 17-GB file of half a million supposedly private photos was uploaded to a BitTorrent site.

In the early days of the web, I remember feeling giddy over the wealth of information out there and how easy it was to get to. “The internet is my hard drive,” I told newbies. It’s even more true today; I don’t think I could write without so much information so easily accessible. But it’s a pretty damned unreliable hard drive.

The internet is my hard drive, but only if my needs are immediate and my requirements can be satisfied inexactly. It was easy for me to search for information about the MySpace photo hack. And it will be easy to look up, and respond to, comments to this essay, both on Wired.com and on my own blog. Wired.com is a commercial venture, so there is advertising value in keeping everything accessible. My site is not at all commercial, but there is personal value in keeping everything accessible. By that analysis, all sites should be up on the internet forever, although that’s certainly not true. What is true is that there’s no way to predict what will disappear when.

Unfortunately, there’s not much we can do about it. The security measures largely aren’t in our hands. We can save copies of important web pages locally, and copies of anything important we post. The Internet Archive is remarkably valuable in saving bits and pieces of the internet. And recently, we’ve started seeing tools for archiving information and pages from social networking sites. But what’s really important is the whole community, and we don’t know which bits we want until they’re no longer there.

And about Wine Therapy, I think it started in 2000. It might have been 2001. I can’t check, because someone erased the archives.

Research on Malware Distribution

Interesting:

Among their conclusions are that the majority of malware distribution sites are hosted in China, and that 1.3% of Google searches return at least one link to a malicious site. The lead author, Niels Provos, wrote, ‘It has been over a year and a half since we started to identify web pages that infect vulnerable hosts via drive-by downloads, i.e. web pages that attempt to exploit their visitors by installing and running malware automatically. During that time we have investigated billions of URLs and found more than three million unique URLs on over 180,000 web sites automatically installing malware. During the course of our research, we have investigated not only the prevalence of drive-by downloads but also how users are being exposed to malware and how it is being distributed.'”

Is Sears Engaging in Criminal Hacking Behavior?

Join “My SHC Community” on Sears.com, and the company will install some pretty impressive spyware on your computer:

Sears.com is distributing spyware that tracks all your Internet usage – including banking logins, email, and all other forms of Internet usage – all in the name of “community participation.” Every website visitor that joins the Sears community installs software that acts as a proxy to every web transaction made on the compromised computer. In other words, if you have installed Sears software (“the proxy”) on your system, all data transmitted to and from your system will be intercepted. This extreme level of user tracking is done with little and inconspicuous notice about the true nature of the software. In fact, while registering to join the “community,” very little mention is made of software or tracking. Furthermore, after the software is installed, there is no indication on the desktop that the proxy exists on the system, so users are tracked silently.

Here is a summary of what the software does and how it is used. The proxy:

  1. Monitors and transmits a copy of all Internet traffic going from and coming to the compromised system.
  2. Monitors secure sessions (websites beginning with ‘https’), which may include shopping or banking sites.
  3. Records and transmits “the pace and style with which you enter information online…”
  4. Parses the header section of personal emails.
  5. May combine any data intercepted with additional information like “select credit bureau information” and other sources like “consumer preference reporting companies or credit reporting agencies”.

    If a kid with a scary hacker name did this sort of thing, he’d be arrested. But this is Sears, so who knows what will happen to them. But what should happen is that the anti-spyware companies should treat this as the malware it is, and not ignore it because it’s done by a Fortune 500 company.

    Privacy Problems with AskEraser

    Last week, Ask.com announced a feature called AskEraser (good description here), which erases a user’s search history. While it’s great to see companies using privacy features for competitive advantage, EPIC examined the feature and wrote to the company with some problems:

    The first one is the fact that AskEraser uses an opt-out cookie. Cookies are bits of software left on a consumer’s computer that are used to authenticate the user and maintain information such as the user’s site preferences.

    Usually, people concerned with privacy delete cookies, so creating an opt-out cookie is “counter-intuitive,” the letter states. Once the AskEraser opt-out cookie is deleted, the privacy setting is lost and the consumer’s search activity will be tracked. Why not have an opt-in cookie instead, the letter suggests.

    The second problem is that Ask inserts the exact time that the user enables AskEraser and stores it in the cookie, which could make identifying the computer easier and make it easy for third-party tracking if the cookie were transferred to such parties. The letter recommends using a session cookie that expires once the search result is returned.

    Ask’s Frequently Asked Questions for the feature notes that there may be circumstances when Ask is required to comply with a court order and if asked to, it will retain the consumer’s search data even if AskEraser appears to be turned on. Ask should notify consumers when the feature has been disabled so that people are not misled into thinking their searches aren’t being tracked when they actually are, the letter said.

    Here’s a copy of the letter, signed by eight privacy organizations. Still no word from Ask.com.

    While I have your attention, I want to talk about EPIC. This is exactly the sort of thing the Electronic Privacy Information Center does best. Whether it’s search engine privacy, electronic voting, ID cards, or databases and data mining, EPIC is always at the forefront of these sorts of privacy issues.
