DRM in Windows Vista

Windows Vista includes an array of “features” that you don’t want. These features will make your computer less reliable and less secure. They’ll make your computer less stable and run slower. They will cause technical support problems. They may even require you to upgrade some of your peripheral hardware and existing software. And these features won’t do anything useful. In fact, they’re working against you. They’re digital rights management (DRM) features built into Vista at the behest of the entertainment industry.

And you don’t get to refuse them.

The details are pretty geeky, but basically Microsoft has reworked a lot of the core operating system to add copy protection technology for new media formats like HD DVD and Blu-ray disks. Certain high-quality output paths—audio and video—are reserved for protected peripheral devices. Sometimes output quality is artificially degraded; sometimes output is prevented entirely. And Vista continuously spends CPU time monitoring itself, trying to figure out if you’re doing something that it thinks you shouldn’t. If it does, it limits functionality and in extreme cases restarts just the video subsystem. We still don’t know the exact details of all this, and how far-reaching it is, but it doesn’t look good.

Microsoft put all those functionality-crippling features into Vista because it wants to own the entertainment industry. This isn’t how Microsoft spins it, of course. It maintains that it has no choice, that it’s Hollywood that is demanding DRM in Windows in order to allow “premium content”—meaning, new movies that are still earning revenue—onto your computer. If Microsoft didn’t play along, it’d be relegated to second-class status as Hollywood pulled its support for the platform.

It’s all complete nonsense. Microsoft could have easily told the entertainment industry that it was not going to deliberately cripple its operating system, take it or leave it. With 95% of the operating system market, where else would Hollywood go? Sure, Big Media has been pushing DRM, but recently some—Sony after their 2005 debacle and now EMI Group—are having second thoughts.

What the entertainment companies are finally realizing is that DRM doesn’t work, and just annoys their customers. Like every other DRM system ever invented, Microsoft’s won’t keep the professional pirates from making copies of whatever they want. The DRM security in Vista was broken the day it was released. Sure, Microsoft will patch it, but the patched system will get broken as well. It’s an arms race, and the defenders can’t possibly win.

I believe that Microsoft knows this and also knows that it doesn’t matter. This isn’t about stopping pirates and the small percentage of people who download free movies from the Internet. This isn’t even about Microsoft satisfying its Hollywood customers at the expense of those of us paying for the privilege of using Vista. This is about the overwhelming majority of honest users and who owns the distribution channels to them. And while it may have started as a partnership, in the end Microsoft is going to end up locking the movie companies into selling content in its proprietary formats.

We saw this trick before; Apple pulled it on the recording industry. First iTunes worked in partnership with the major record labels to distribute content, but soon Warner Music’s CEO Edgar Bronfman Jr. found that he wasn’t able to dictate a pricing model to Steve Jobs. The same thing will happen here; after Vista is firmly entrenched in the marketplace, Sony’s Howard Stringer won’t be able to dictate pricing or terms to Bill Gates. This is a war for 21st-century movie distribution and, when the dust settles, Hollywood won’t know what hit them.

To be fair, just last week Steve Jobs publicly came out against DRM for music. It’s a reasonable business position, now that Apple controls the online music distribution market. But Jobs never mentioned movies, and he is the largest single shareholder in Disney. Talk is cheap. The real question is would he actually allow iTunes Music Store purchases to play on Microsoft or Sony players, or is this just a clever way of deflecting blame to the—already hated—music labels.

Microsoft is reaching for a much bigger prize than Apple: not just Hollywood, but also peripheral hardware vendors. Vista’s DRM will require driver developers to comply with all kinds of rules and be certified; otherwise, they won’t work. And Microsoft talks about expanding this to independent software vendors as well. It’s another war for control of the computer market.

Unfortunately, we users are caught in the crossfire. We are not only stuck with DRM systems that interfere with our legitimate fair-use rights for the content we buy, we’re stuck with DRM systems that interfere with all of our computer use—even the uses that have nothing to do with copyright.

I don’t see the market righting this wrong, because Microsoft’s monopoly position gives it much more power than we consumers can hope to have. It might not be as obvious as Microsoft using its operating system monopoly to kill Netscape and own the browser market, but it’s really no different. Microsoft’s entertainment market grab might further entrench its monopoly position, but it will cause serious damage to both the computer and entertainment industries. DRM is bad, both for consumers and for the entertainment industry: something the entertainment industry is just starting to realize, but Microsoft is still fighting. Some researchers think that this is the final straw that will drive Windows users to the competition, but I think the courts are necessary.

In the meantime, the only advice I can offer you is to not upgrade to Vista. It will be hard. Microsoft’s bundling deals with computer manufacturers mean that it will be increasingly hard not to get the new operating system with new computers. And Microsoft has some pretty deep pockets and can wait us all out if it wants to. Yes, some people will shift to Macintosh and some fewer number to Linux, but most of us are stuck on Windows. Still, if enough customers say no to Vista, the company might actually listen.

NSA Helps Microsoft with Windows Vista

Is this a good idea or not?

For the first time, the giant software maker is acknowledging the help of the secretive agency, better known for eavesdropping on foreign officials and, more recently, U.S. citizens as part of the Bush administration’s effort to combat terrorism. The agency said it has helped in the development of the security of Microsoft’s new operating system—the brains of a computer—to protect it from worms, Trojan horses and other insidious computer attackers.

The NSA declined to comment on its security work with other software firms, but Sager said Microsoft is the only one “with this kind of relationship at this point where there’s an acknowledgment publicly.”

The NSA, which provided its service free, said it was Microsoft’s idea to acknowledge the spy agency’s role.

It’s called the “equities issue.” Basically, the NSA has two roles: eavesdrop on their stuff, and protect our stuff. When both sides use the same stuff—Windows Vista, for example—the agency has to decide whether to exploit vulnerabilities to eavesdrop on their stuff or close the same vulnerabilities to protect our stuff. In its partnership with Microsoft, it could have decided to go either way: to deliberately introduce vulnerabilities that it could exploit, or deliberately harden the OS to protect its own interests.

A few years ago I was ready to believe the NSA recognized we’re all safer with more secure general-purpose computers and networks, but in the post-9/11 take-the-gloves-off eavesdrop-on-everybody environment, I simply don’t trust the NSA to do the right thing.

“I kind of call it a Good Housekeeping seal” of approval, said Michael Cherry, a former Windows program manager who now analyzes the product for Directions on Microsoft, a firm that tracks the software maker.

Cherry says the NSA’s involvement can help counter the perception that Windows is not entirely secure and help create a perception that Microsoft has solved the security problems that have plagued it in the past. “Microsoft also wants to make the case that [the new Windows] more secure than its earlier versions,” he said.

For some of us, the result is the exact opposite.

A Cost Analysis of Windows Vista Content Protection

Peter Gutman’s “A Cost Analysis of Windows Vista Content Protection” is fascinating reading:

Executive Summary

Windows Vista includes an extensive reworking of core OS elements in order to provide content protection for so-called “premium content”, typically HD data from Blu-Ray and HD-DVD sources. Providing this protection incurs considerable costs in terms of system performance, system stability, technical support overhead, and hardware and software cost. These issues affect not only users of Vista but the entire PC industry, since the effects of the protection measures extend to cover all hardware and software that will ever come into contact with Vista, even if it’s not used directly with Vista (for example hardware in a Macintosh computer or on a Linux server). This document analyses the cost involved in Vista’s content protection, and the collateral damage that this incurs throughout the computer industry.

Executive Executive Summary

The Vista Content Protection specification could very well constitute the longest suicide note in history.

It contains stuff like:

Denial-of-Service via Driver Revocation

Once a weakness is found in a particular driver or device, that driver will have its signature revoked by Microsoft, which means that it will cease to function (details on this are a bit vague here, presumably some minimum functionality like generic 640×480 VGA support will still be available in order for the system to boot). This means that a report of a compromise of a particular driver or device will cause all support for that device worldwide to be turned off until a fix can be found. Again, details are sketchy, but if it’s a device problem then presumably the device turns into a paperweight once it’s revoked. If it’s an older device for which the vendor isn’t interested in rewriting their drivers (and in the fast-moving hardware market most devices enter “legacy” status within a year of two of their replacement models becoming available), all devices of that type worldwide become permanently unusable.

Microsoft and FairUse4WM

If you really want to see Microsoft scramble to patch a hole in its software, don’t look to vulnerabilities that impact countless Internet Explorer users or give intruders control of thousands of Windows machines. Just crack Redmond’s DRM.

Security patches used to be rare. Software vendors were happy to pretend that vulnerabilities in their products were illusory—and then quietly fix the problem in the next software release.

That changed with the full disclosure movement. Independent security researchers started going public with the holes they found, making vulnerabilities impossible for vendors to ignore. Then worms became more common; patching—and patching quickly—became the norm.

But even now, no software vendor likes to issue patches. Every patch is a public admission that the company made a mistake. Moreover, the process diverts engineering resources from new development. Patches annoy users by making them update their software, and piss them off even more if the update doesn’t work properly.

For the vendor, there’s an economic balancing act: how much more will your users be annoyed by unpatched software than they will be by the patch, and is that reduction in annoyance worth the cost of patching?

Since 2003, Microsoft’s strategy to balance these costs and benefits has been to batch patches: instead of issuing them one at a time, it’s been issuing them all together on the second Tuesday of each month. This decreases Microsoft’s development costs and increases the reliability of its patches.

The user pays for this strategy by remaining open to known vulnerabilities for up to a month. On the other hand, users benefit from a predictable schedule: Microsoft can test all the patches that are going out at the same time, which means that patches are more reliable and users are able to install them faster with more confidence.

In the absence of regulation, software liability, or some other mechanism to make unpatched software costly for the vendor, “Patch Tuesday” is the best users are likely to get.

Why? Because it makes near-term financial sense to Microsoft. The company is not a public charity, and if the internet suffers, or if computers are compromised en masse, the economic impact on Microsoft is still minimal.

Microsoft is in the business of making money, and keeping users secure by patching its software is only incidental to that goal.

There’s no better example of this of this principle in action than Microsoft’s behavior around the vulnerability in its digital rights management software PlaysForSure.

Last week, a hacker developed an application called FairUse4WM that strips the copy protection from Windows Media DRM 10 and 11 files.

Now, this isn’t a “vulnerability” in the normal sense of the word: digital rights management is not a feature that users want. Being able to remove copy protection is a good thing for some users, and completely irrelevant for everyone else. No user is ever going to say: “Oh no. I can now play the music I bought for my computer in my car. I must install a patch so I can’t do that anymore.”

But to Microsoft, this vulnerability is a big deal. It affects the company’s relationship with major record labels. It affects the company’s product offerings. It affects the company’s bottom line. Fixing this “vulnerability” is in the company’s best interest; never mind the customer.

So Microsoft wasted no time; it issued a patch three days after learning about the hack. There’s no month-long wait for copyright holders who rely on Microsoft’s DRM.

This clearly demonstrates that economics is a much more powerful motivator than security.

It should surprise no one that the system didn’t stay patched for long. FairUse4WM 1.2 gets around Microsoft’s patch, and also circumvents the copy protection in Windows Media DRM 9 and 11beta2 files.

That was Saturday. Any guess on how long it will take Microsoft to patch Media Player once again? And then how long before the FairUse4WM people update their own software?

Certainly much less time than it will take Microsoft and the recording industry to realize they’re playing a losing game, and that trying to make digital files uncopyable is like trying to make water not wet.

If Microsoft abandoned this Sisyphean effort and put the same development effort into building a fast and reliable patching system, the entire internet would benefit. But simple economics says it probably never will.

Microsoft Windows Kill Switch

Does Microsoft have the ability to disable Windows remotely? Maybe:

Two weeks ago, I wrote about my serious objections to Microsoft’s latest salvo in the war against unauthorized copies of Windows. Two Windows Genuine Advantage components are being pushed onto users’ machines with insufficient notification and inadequate quality control, and the result is a big mess. (For details, see Microsoft presses the Stupid button.)

Guess what? WGA might be on the verge of getting even messier. In fact, one report claims WGA is about to become a Windows “kill switch” ­ and when I asked Microsoft for an on-the-record response, they refused to deny it.

And this, supposedly from someone at Microsoft Support:

He told me that “in the fall, having the latest WGA will become mandatory and if its not installed, Windows will give a 30 day warning and when the 30 days is up and WGA isn’t installed, Windows will stop working, so you might as well install WGA now.”

The stupidity of this idea is amazing. Not just the inevitability of false positives, but the potential for a hacker to co-opt the controls. I hope this rumor ends up not being true.

Although if they actually do it, the backlash could do more for non-Windows OSs than anything those OSs could do for themselves.

Hacking Computers Over USB

I’ve previously written about the risks of small portable computing devices; how more and more data can be stored on them, and then lost or stolen. But there’s another risk: if an attacker can convince you to plug his USB device into your computer, he can take it over.

Plug an iPod or USB stick into a PC running Windows and the device can literally take over the machine and search for confidential documents, copy them back to the iPod or USB’s internal storage, and hide them as “deleted” files. Alternatively, the device can simply plant spyware, or even compromise the operating system. Two features that make this possible are the Windows AutoRun facility and the ability of peripherals to use something called direct memory access (DMA). The first attack vector you can and should plug; the second vector is the result of a design flaw that’s likely to be with us for many years to come.

The article has the details, but basically you can configure a file on your USB device to automatically run when it’s plugged into a computer. That file can, of course, do anything you want it to.

Recently I’ve been seeing more and more written about this attack. The Spring 2006 issue of 2600 Magazine, for example, contains a short article called “iPod Sneakiness” (unfortunately, not on line). The author suggests that you can innocently ask someone at an Internet cafe if you can plug your iPod into his computer to power it up—and then steal his passwords and critical files.

And here’s an article about someone who used this trick in a penetration test:

We figured we would try something different by baiting the same employees that were on high alert. We gathered all the worthless vendor giveaway thumb drives collected over the years and imprinted them with our own special piece of software. I had one of my guys write a Trojan that, when run, would collect passwords, logins and machine-specific information from the user’s computer, and then email the findings back to us.

The next hurdle we had was getting the USB drives in the hands of the credit union’s internal users. I made my way to the credit union at about 6 a.m. to make sure no employees saw us. I then proceeded to scatter the drives in the parking lot, smoking areas, and other areas employees frequented.

Once I seeded the USB drives, I decided to grab some coffee and watch the employees show up for work. Surveillance of the facility was worth the time involved. It was really amusing to watch the reaction of the employees who found a USB drive. You know they plugged them into their computers the minute they got to their desks.

I immediately called my guy that wrote the Trojan and asked if anything was received at his end. Slowly but surely info was being mailed back to him. I would have loved to be on the inside of the building watching as people started plugging the USB drives in, scouring through the planted image files, then unknowingly running our piece of software.

There is a defense. From the first article:

AutoRun is just a bad idea. People putting CD-ROMs or USB drives into their computers usually want to see what’s on the media, not have programs automatically run. Fortunately you can turn AutoRun off. A simple manual approach is to hold down the “Shift” key when a disk or USB storage device is inserted into the computer. A better way is to disable the feature entirely by editing the Windows Registry. There are many instructions for doing this online (just search for “disable autorun”) or you can download and use Microsoft’s TweakUI program, which is part of the Windows XP PowerToys download. With Windows XP you can also disable AutoRun for CDs by right-clicking on the CD drive icon in the Windows explorer, choosing the AutoPlay tab, and then selecting “Take no action” for each kind of disk that’s listed. Unfortunately, disabling AutoPlay for CDs won’t always disable AutoPlay for USB devices, so the registry hack is the safest course of action.

In the 1990s, the Macintosh operating system had this feature, which was removed after a virus made use of it in 1998. Microsoft needs to remove this feature as well.

Who Owns Your Computer?

When technology serves its owners, it is liberating. When it is designed to serve others, over the owner’s objection, it is oppressive. There’s a battle raging on your computer right now—one that pits you against worms and viruses, Trojans, spyware, automatic update features and digital rights management technologies. It’s the battle to determine who owns your computer.

You own your computer, of course. You bought it. You paid for it. But how much control do you really have over what happens on your machine? Technically you might have bought the hardware and software, but you have less control over what it’s doing behind the scenes.

Using the hacker sense of the term, your computer is “owned” by other people.

It used to be that only malicious hackers were trying to own your computers. Whether through worms, viruses, Trojans or other means, they would try to install some kind of remote-control program onto your system. Then they’d use your computers to sniff passwords, make fraudulent bank transactions, send spam, initiate phishing attacks and so on. Estimates are that somewhere between hundreds of thousands and millions of computers are members of remotely controlled “bot” networks. Owned.

Now, things are not so simple. There are all sorts of interests vying for control of your computer. There are media companies that want to control what you can do with the music and videos they sell you. There are companies that use software as a conduit to collect marketing information, deliver advertising or do whatever it is their real owners require. And there are software companies that are trying to make money by pleasing not only their customers, but other companies they ally themselves with. All these companies want to own your computer.

Some examples:

  • Entertainment software: In October 2005, it emerged that Sony had distributed a rootkit with several music CDs—the same kind of software that crackers use to own people’s computers. This rootkit secretly installed itself when the music CD was played on a computer. Its purpose was to prevent people from doing things with the music that Sony didn’t approve of: It was a DRM system. If the exact same piece of software had been installed secretly by a hacker, this would have been an illegal act. But Sony believed that it had legitimate reasons for wanting to own its customers’ machines.
  • Antivirus: You might have expected your antivirus software to detect Sony’s rootkit. After all, that’s why you bought it. But initially, the security programs sold by Symantec and others did not detect it, because Sony had asked them not to. You might have thought that the software you bought was working for you, but you would have been wrong.
  • Internet services: Hotmail allows you to blacklist certain e-mail addresses, so that mail from them automatically goes into your spam trap. Have you ever tried blocking all that incessant marketing e-mail from Microsoft? You can’t.
  • Application software: Internet Explorer users might have expected the program to incorporate easy-to-use cookie handling and pop-up blockers. After all, other browsers do, and users have found them useful in defending against Internet annoyances. But Microsoft isn’t just selling software to you; it sells Internet advertising as well. It isn’t in the company’s best interest to offer users features that would adversely affect its business partners.
  • Spyware: Spyware is nothing but someone else trying to own your computer. These programs eavesdrop on your behavior and report back to their real owners—sometimes without your knowledge or consent—about your behavior.
  • Internet security: It recently came out that the firewall in Microsoft Vista will ship with half its protections turned off. Microsoft claims that large enterprise users demanded this default configuration, but that makes no sense. It’s far more likely that Microsoft just doesn’t want adware—and DRM spyware—blocked by default.
  • Update: Automatic update features are another way software companies try to own your computer. While they can be useful for improving security, they also require you to trust your software vendor not to disable your computer for nonpayment, breach of contract or other presumed infractions.

Adware, software-as-a-service and Google Desktop search are all examples of some other company trying to own your computer. And Trusted Computing will only make the problem worse.

There is an inherent insecurity to technologies that try to own people’s computers: They allow individuals other than the computers’ legitimate owners to enforce policy on those machines. These systems invite attackers to assume the role of the third party and turn a user’s device against him.

Remember the Sony story: The most insecure feature in that DRM system was a cloaking mechanism that gave the rootkit control over whether you could see it executing or spot its files on your hard disk. By taking ownership away from you, it reduced your security.

If left to grow, these external control systems will fundamentally change your relationship with your computer. They will make your computer much less useful by letting corporations limit what you can do with it. They will make your computer much less reliable because you will no longer have control of what is running on your machine, what it does, and how the various software components interact. At the extreme, they will transform your computer into a glorified boob tube.

You can fight back against this trend by only using software that respects your boundaries. Boycott companies that don’t honestly serve their customers, that don’t disclose their alliances, that treat users like marketing assets. Use open-source software—software created and owned by users, with no hidden agendas, no secret alliances and no back-room marketing deals.

Just because computers were a liberating force in the past doesn’t mean they will be in the future. There is enormous political and economic power behind the idea that you shouldn’t truly own your computer or your software, despite having paid for it.
