The NSA is Commandeering the Internet

It turns out that the NSA’s domestic and world-wide surveillance apparatus is even more extensive than we thought. Bluntly: The government has commandeered the Internet. Most of the largest Internet companies provide information to the NSA, betraying their users. Some, as we’ve learned, fight and lose. Others cooperate, either out of patriotism or because they believe it’s easier that way.

I have one message to the executives of those companies: fight.

Do you remember those old spy movies, when the higher ups in government decide that the mission is more important than the spy’s life? It’s going to be the same way with you. You might think that your friendly relationship with the government means that they’re going to protect you, but they won’t. The NSA doesn’t care about you or your customers, and will burn you the moment it’s convenient to do so.

We’re already starting to see that. Google, Yahoo, Microsoft and others are pleading with the government to allow them to explain details of what information they provided in response to National Security Letters and other government demands. They’ve lost the trust of their customers, and explaining what they do—and don’t do—is how to get it back. The government has refused; they don’t care.

It will be the same with you. There are lots more high-tech companies who have cooperated with the government. Most of those company names are somewhere in the thousands of documents that Edward Snowden took with him, and sooner or later they’ll be released to the public. The NSA probably told you that your cooperation would forever remain secret, but they’re sloppy. They’ll put your company name on presentations delivered to thousands of people: government employees, contractors, probably even foreign nationals. If Snowden doesn’t have a copy, the next whistleblower will.

This is why you have to fight. When it becomes public that the NSA has been hoovering up all of your users’ communications and personal files, what’s going to save you in the eyes of those users is whether or not you fought. Fighting will cost you money in the short term, but capitulating will cost you more in the long term.

Already companies are taking their data and communications out of the US.

The extreme case of fighting is shutting down entirely. The secure e-mail service Lavabit did that last week, abruptly. Ladar Levison, that site’s owner, wrote on his homepage: “I have been forced to make a difficult decision: to become complicit in crimes against the American people or walk away from nearly ten years of hard work by shutting down Lavabit. After significant soul searching, I have decided to suspend operations. I wish that I could legally share with you the events that led to my decision.”

The same day, Silent Circle followed suit, shutting down their e-mail service in advance of any government strong-arm tactics: “We see the writing the wall, and we have decided that it is best for us to shut down Silent Mail now. We have not received subpoenas, warrants, security letters, or anything else by any government, and this is why we are acting now.” I realize that this is extreme. Both of those companies can do it because they’re small. Google or Facebook couldn’t possibly shut themselves off rather than cooperate with the government. They’re too large; they’re public. They have to do what’s economically rational, not what’s moral.

But they can fight. You, an executive in one of those companies, can fight. You’ll probably lose, but you need to take the stand. And you might win. It’s time we called the government’s actions what they really are: commandeering. Commandeering is a practice we’re used to in wartime, where commercial ships are taken for military use, or production lines are converted to military production. But now it’s happening in peacetime. Vast swaths of the Internet are being commandeered to support this surveillance state.

If this is happening to your company, do what you can to isolate the actions. Do you have employees with security clearances who can’t tell you what they’re doing? Cut off all automatic lines of communication with them, and make sure that only specific, required, authorized acts are being taken on behalf of government. Only then can you look your customers and the public in the face and say that you don’t know what is going on—that your company has been commandeered.

Journalism professor Jeff Jarvis recently wrote in the Guardian: “Technology companies: now is the moment when you must answer for us, your users, whether you are collaborators in the US government’s efforts to ‘collect it all—our every move on the internet—or whether you, too, are victims of its overreach.”

So while I’m sure it’s cool to have a secret White House meeting with President Obama—I’m talking to you, Google, Apple, AT&T, and whoever else was in the room—resist. Attend the meeting, but fight the secrecy. Whose side are you on?

The NSA isn’t going to remain above the law forever. Already public opinion is changing, against the government and their corporate collaborators. If you want to keep your users’ trust, demonstrate that you were on their side.

Restoring Trust in Government and the Internet

In July 2012, responding to allegations that the video-chat service Skype—owned by Microsoft—was changing its protocols to make it possible for the government to eavesdrop on users, Corporate Vice President Mark Gillett took to the company’s blog to deny it.

Turns out that wasn’t quite true.

Or at least he—or the company’s lawyers—carefully crafted a statement that could be defended as true while completely deceiving the reader. You see, Skype wasn’t changing its protocols to make it possible for the government to eavesdrop on users, because the government was already able to eavesdrop on users.

At a Senate hearing in March, Director of National Intelligence James Clapper assured the committee that his agency didn’t collect data on hundreds of millions of Americans. He was lying, too. He later defended his lie by inventing a new definition of the word “collect,” an excuse that didn’t even pass the laugh test.

As Edward Snowden’s documents reveal more about the NSA’s activities, it’s becoming clear that we can’t trust anything anyone official says about these programs.

Google and Facebook insist that the NSA has no “direct access” to their servers. Of course not; the smart way for the NSA to get all the data is through sniffers.

Apple says it’s never heard of PRISM. Of course not; that’s the internal name of the NSA database. Companies are publishing reports purporting to show how few requests for customer-data access they’ve received, a meaningless number when a single Verizon request can cover all of their customers. The Guardian reported that Microsoft secretly worked with the NSA to subvert the security of Outlook, something it carefully denies. Even President Obama’s justifications and denials are phrased with the intent that the listener will take his words very literally and not wonder what they really mean.

NSA Director Gen. Keith Alexander has claimed that the NSA’s massive surveillance and data mining programs have helped stop more than 50 terrorist plots, 10 inside the U.S. Do you believe him? I think it depends on your definition of “helped.” We’re not told whether these programs were instrumental in foiling the plots or whether they just happened to be of minor help because the data was there. It also depends on your definition of “terrorist plots.” An examination of plots that that FBI claims to have foiled since 9/11 reveals that would-be terrorists have commonly been delusional, and most have been egged on by FBI undercover agents or informants.

Left alone, few were likely to have accomplished much of anything.

Both government agencies and corporations have cloaked themselves in so much secrecy that it’s impossible to verify anything they say; revelation after revelation demonstrates that they’ve been lying to us regularly and tell the truth only when there’s no alternative.

There’s much more to come. Right now, the press has published only a tiny percentage of the documents Snowden took with him. And Snowden’s files are only a tiny percentage of the number of secrets our government is keeping, awaiting the next whistle-blower.

Ronald Reagan once said “trust but verify.” That works only if we can verify. In a world where everyone lies to us all the time, we have no choice but to trust blindly, and we have no reason to believe that anyone is worthy of blind trust. It’s no wonder that most people are ignoring the story; it’s just too much cognitive dissonance to try to cope with it.

This sort of thing can destroy our country. Trust is essential in our society. And if we can’t trust either our government or the corporations that have intimate access into so much of our lives, society suffers. Study after study demonstrates the value of living in a high-trust society and the costs of living in a low-trust one.

Rebuilding trust is not easy, as anyone who has betrayed or been betrayed by a friend or lover knows, but the path involves transparency, oversight and accountability. Transparency first involves coming clean. Not a little bit at a time, not only when you have to, but complete disclosure about everything. Then it involves continuing disclosure. No more secret rulings by secret courts about secret laws. No more secret programs whose costs and benefits remain hidden.

Oversight involves meaningful constraints on the NSA, the FBI and others. This will be a combination of things: a court system that acts as a third-party advocate for the rule of law rather than a rubber-stamp organization, a legislature that understands what these organizations are doing and regularly debates requests for increased power, and vibrant public-sector watchdog groups that analyze and debate the government’s actions.

Accountability means that those who break the law, lie to Congress or deceive the American people are held accountable. The NSA has gone rogue, and while it’s probably not possible to prosecute people for what they did under the enormous veil of secrecy it currently enjoys, we need to make it clear that this behavior will not be tolerated in the future. Accountability also means voting, which means voters need to know what our leaders are doing in our name.

This is the only way we can restore trust. A market economy doesn’t work unless consumers can make intelligent buying decisions based on accurate product information. That’s why we have agencies like the FDA, truth-in-packaging laws and prohibitions against false advertising.

In the same way, democracy can’t work unless voters know what the government is doing in their name. That’s why we have open-government laws. Secret courts making secret rulings on secret laws, and companies flagrantly lying to consumers about the insecurity of their products and services, undermine the very foundations of our society.

Since the Snowden documents became public, I have been receiving e-mails from people seeking advice on whom to trust. As a security and privacy expert, I’m expected to know which companies protect their users’ privacy and which encryption programs the NSA can’t break. The truth is, I have no idea. No one outside the classified government world does. I tell people that they have no choice but to decide whom they trust and to then trust them as a matter of faith. It’s a lousy answer, but until our government starts down the path of regaining our trust, it’s the only thing we can do.

US Department of Defense Censors Snowden Story

The US Department of Defense is blocking sites that are reporting about the Snowden documents. I presume they’re not censoring sites that are smearing him personally. Note that the DoD is only blocking those sites on its own network, not on the Internet at large. The blocking is being done by automatic filters, presumably the same ones used to block porn or other sites it deems inappropriate.

Anyone know if my blog is being censored? I’m kinda curious.

Blowback from the NSA Surveillance

There’s one piece of blowback that isn’t being discussed—aside from the fact that Snowden has killed the chances of any liberal arts major getting a DoD job for at least a decade—and that’s how the massive NSA surveillance of the Internet affects the US’s role in Internet governance.

Ron Deibert makes this point:

But there are unintended consequences of the NSA scandal that will undermine U.S. foreign policy interests—in particular, the “Internet Freedom” agenda espoused by the U.S. State Department and its allies.

The revelations that have emerged will undoubtedly trigger a reaction abroad as policymakers and ordinary users realize the huge disadvantages of their dependence on U.S.-controlled networks in social media, cloud computing, and telecommunications, and of the formidable resources that are deployed by U.S. national security agencies to mine and monitor those networks.

Writing about the new Internet nationalism, I talked about the ITU meeting in Dubai last fall, and the attempt of some countries to wrest control of the Internet from the US. That movement just got a huge PR boost. Now, when countries like Russia and Iran say the US is simply too untrustworthy to manage the Internet, no one will be able to argue.

We can’t fight for Internet freedom around the world, then turn around and destroy it back home. Even if we don’t see the contradiction, the rest of the world does.

"The Global Cyber Game"

This 127-page report was just published by the UK Defence Academy. I have not read it yet, but it looks really interesting.

Executive Summary: This report presents a systematic way of thinking about cyberpower and its use by a variety of global players. The urgency of addressing cyberpower in this way is a consequence of the very high value of the Internet and the hazards of its current militarization.

Cyberpower and cyber security are conceptualized as a ‘Global Game’ with a novel ‘Cyber Gameboard’ consisting of a nine-cell grid. The horizontal direction on the grid is divided into three columns representing aspects of information (i.e. cyber): connection, computation and cognition. The vertical direction on the grid is divided into three rows representing types of power: coercion, co-option, and cooperation. The nine cells of the grid represent all the possible combinations of power and information, that is, forms of cyberpower.

The Cyber Gameboard itself is also an abstract representation of the surface of cyberspace, or C-space as defined in this report. C-space is understood as a networked medium capable of conveying various combinations of power and information to produce effects in physical or ‘flow space,’ referred to as F-space in this report. Game play is understood as the projection via C-space of a cyberpower capability existing in any one cell of the gameboard to produce an effect in F-space vis-a-vis another player in any other cell of the gameboard. By default, the Cyber Game is played either actively or passively by all those using network connected computers. The players include states, businesses, NGOs, individuals, non-state political groups, and organized crime, among others. Each player is seen as having a certain level of cyberpower when its capability in each cell is summed across the whole board. In general states have the most cyberpower.

The possible future path of the game is depicted by two scenarios, N-topia and N-crash. These are the stakes for which the Cyber Game is played. N-topia represents the upside potential of the game, in which the full value of a globally connected knowledge society is realized. N-crash represents the downside potential, in which militarization and fragmentation of the Internet cause its value to be substantially destroyed. Which scenario eventuates will be determined largely by the overall pattern of play of the Cyber Game.

States have a high level of responsibility for determining the outcome. The current pattern of play is beginning to resemble traditional state-on-state geopolitical conflict. This puts the civil Internet at risk, and civilian cyber players are already getting caught in the crossfire. As long as the civil Internet remains undefended and easily permeable to cyber attack it will be hard to achieve the N-topia scenario.

Defending the civil Internet in depth, and hardening it by re-architecting will allow its full social and economic value to be realized but will restrict the potential for espionage and surveillance by states. This trade-off is net positive and in accordance with the espoused values of Western-style democracies. It does however call for leadership based on enlightened self-interest by state players.

DDOS as Civil Disobedience

For a while now, I have been thinking about what civil disobedience looks like in the Internet Age. Certainly DDOS attacks, and politically motivated hacking in general, is a part of that. This is one of the reasons I found Molly Sauter’s recent thesis, “Distributed Denial of Service Actions and the Challenge of Civil Disobedience on the Internet,” so interesting:

Abstract: This thesis examines the history, development, theory, and practice of distributed denial of service actions as a tactic of political activism. DDOS actions have been used in online political activism since the early 1990s, though the tactic has recently attracted significant public attention with the actions of Anonymous and Operation Payback in December 2010. Guiding this work is the overarching question of how civil disobedience and disruptive activism can be practiced in the current online space. The internet acts as a vital arena of communication, self expression, and interpersonal organizing. When there is a message to convey, words to get out, people to organize, many will turn to the internet as the zone of that activity. Online, people sign petitions, investigate stories and rumors, amplify links and videos, donate money, and show their support for causes in a variety of ways. But as familiar and widely accepted activist tools—petitions, fundraisers, mass letter-writing, call-in campaigns and others—find equivalent practices in the online space, is there also room for the tactics of disruption and civil disobedience that are equally familiar from the realm of street marches, occupations, and sit-ins? This thesis grounds activist DDOS historically, focusing on early deployments of the tactic as well as modern instances to trace its development over time, both in theory and in practice. Through that examination, as well as tool design and development, participant identity, and state and corporate responses, this thesis presents an account of the development and current state of activist DDOS actions. It ends by presenting an analytical framework for the analysis of activist DDOS actions.

One of the problems with the legal system is that it doesn’t make any differentiation between civil disobedience and “normal” criminal activity on the Internet, though it does in the real world.

Surveillance and the Internet of Things

The Internet has turned into a massive surveillance tool. We’re constantly monitored on the Internet by hundreds of companies—both familiar and unfamiliar. Everything we do there is recorded, collected, and collated—sometimes by corporations wanting to sell us stuff and sometimes by governments wanting to keep an eye on us.

Ephemeral conversation is over. Wholesale surveillance is the norm. Maintaining privacy from these powerful entities is basically impossible, and any illusion of privacy we maintain is based either on ignorance or on our unwillingness to accept what’s really going on.

It’s about to get worse, though. Companies such as Google may know more about your personal interests than your spouse, but so far it’s been limited by the fact that these companies only see computer data. And even though your computer habits are increasingly being linked to your offline behavior, it’s still only behavior that involves computers.

The Internet of Things refers to a world where much more than our computers and cell phones is Internet-enabled. Soon there will be Internet-connected modules on our cars and home appliances. Internet-enabled medical devices will collect real-time health data about us. There’ll be Internet-connected tags on our clothing. In its extreme, everything can be connected to the Internet. It’s really just a matter of time, as these self-powered wireless-enabled computers become smaller and cheaper.

Lots has been written about theInternet of Things” and how it will change society for the better. It’s true that it will make a lot of wonderful things possible, but the “Internet of Things” will also allow for an even greater amount of surveillance than there is today. The Internet of Things gives the governments and corporations that follow our every move something they don’t yet have: eyes and ears.

Soon everything we do, both online and offline, will be recorded and stored forever. The only question remaining is who will have access to all of this information, and under what rules.

We’re seeing an initial glimmer of this from how location sensors on your mobile phone are being used to track you. Of course your cell provider needs to know where you are; it can’t route your phone calls to your phone otherwise. But most of us broadcast our location information to many other companies whose apps we’ve installed on our phone. Google Maps certainly, but also a surprising number of app vendors who collect that information. It can be used to determine where you live, where you work, and who you spend time with.

Another early adopter was Nike, whose Nike+ shoes communicate with your iPod or iPhone and track your exercising. More generally, medical devices are starting to be Internet-enabled, collecting and reporting a variety of health data. Wiring appliances to the Internet is one of the pillars of the smart electric grid. Yes, there are huge potential savings associated with the smart grid, but it will also allow power companies – and anyone they decide to sell the data to—to monitor how people move about their house and how they spend their time.

Drones are another “thing” moving onto the Internet. As their price continues to drop and their capabilities increase, they will become a very powerful surveillance tool. Their cameras are powerful enough to see faces clearly, and there are enough tagged photographs on the Internet to identify many of us. We’re not yet up to a real-time Google Earth equivalent, but it’s not more than a few years away. And drones are just a specific application of CCTV cameras, which have been monitoring us for years, and will increasingly be networked.

Google’s Internet-enabled glasses—Google Glass—are another major step down this path of surveillance. Their ability to record both audio and video will bring ubiquitous surveillance to the next level. Once they’re common, you might never know when you’re being recorded in both audio and video. You might as well assume that everything you do and say will be recorded and saved forever.

In the near term, at least, the sheer volume of data will limit the sorts of conclusions that can be drawn. The invasiveness of these technologies depends on asking the right questions. For example, if a private investigator is watching you in the physical world, she or he might observe odd behavior and investigate further based on that. Such serendipitous observations are harder to achieve when you’re filtering databases based on pre-programmed queries. In other words, it’s easier to ask questions about what you purchased and where you were than to ask what you did with your purchases and why you went where you did. These analytical limitations also mean that companies like Google and Facebook will benefit more from the Internet of Things than individuals—not only because they have access to more data, but also because they have more sophisticated query technology. And as technology continues to improve, the ability to automatically analyze this massive data stream will improve.

In the longer term, the Internet of Things means ubiquitous surveillance. If an object “knows” you have purchased it, and communicates via either Wi-Fi or the mobile network, then whoever or whatever it is communicating with will know where you are. Your car will know who is in it, who is driving, and what traffic laws that driver is following or ignoring. No need to show ID; your identity will already be known. Store clerks could know your name, address, and income level as soon as you walk through the door. Billboards will tailor ads to you, and record how you respond to them. Fast food restaurants will know what you usually order, and exactly how to entice you to order more. Lots of companies will know whom you spend your days—and nights—with. Facebook will know about any new relationship status before you bother to change it on your profile. And all of this information will all be saved, correlated, and studied. Even now, it feels a lot like science fiction.

Will you know any of this? Will your friends? It depends. Lots of these devices have, and will have, privacy settings. But these settings are remarkable not in how much privacy they afford, but in how much they deny. Access will likely be similar to your browsing habits, your files stored on Dropbox, your searches on Google, and your text messages from your phone. All of your data is saved by those companies—and many others—correlated, and then bought and sold without your knowledge or consent. You’d think that your privacy settings would keep random strangers from learning everything about you, but it only keeps random strangers who don’t pay for the privilege—or don’t work for the government and have the ability to demand the data. Power is what matters here: you’ll be able to keep the powerless from invading your privacy, but you’ll have no ability to prevent the powerful from doing it again and again.

Pinging the Entire Internet

Turns out there’s a lot of vulnerable systems out there:

Many of the two terabytes (2,000 gigabytes) worth of replies Moore received from 310 million IPs indicated that they came from devices vulnerable to well-known flaws, or configured in a way that could to let anyone take control of them.

On Tuesday, Moore published results on a particularly troubling segment of those vulnerable devices: ones that appear to be used for business and industrial systems. Over 114,000 of those control connections were logged as being on the Internet with known security flaws. Many could be accessed using default passwords and 13,000 offered direct access through a command prompt without a password at all.

The new work adds to other significant findings from Moore’s unusual hobby. Results he published in January showed that around 50 million printers, games consoles, routers, and networked storage drives are connected to the Internet and easily compromised due to known flaws in a protocol called Universal Plug and Play (UPnP). This protocol allows computers to automatically find printers, but is also built into some security devices, broadband routers, and data storage systems, and could be putting valuable data at risk.

Security Externalities and DDOS Attacks

Ed Felten has a really good blog post about the externalities that the recent Spamhaus DDOS attack exploited:

The attackers’ goal was to flood Spamhaus or its network providers with Internet traffic, to overwhelm their capacity to handle incoming network packets. The main technical problem faced by a DoS attacker is how to amplify the attacker’s traffic-sending capacity, so that the amount of traffic arriving at the target is much greater than the attacker can send himself. To do this, the attacker typically tries to induce many computers around the Internet to send large amounts of traffic to the target.

The first stage of the attack involved the use of a botnet, consisting of a large number of software agents surreptitiously installed on the computers of ordinary users. These bots were commanded to send attack traffic. Notice how this amplifies the attacker’s traffic-sending capability: by sending a few commands to the botnet, the attacker can induce the botnet to send large amounts of attack traffic. This step exploits our first externality: the owners of the bot-infected computers might have done more to prevent the infection, but the harm from this kind of attack activity falls onto strangers, so the computer owners had a reduced incentive to prevent it.

Rather than having the bots send traffic directly to Spamhaus, the attackers used another step to further amplify the volume of traffic. They had the bots send queries to DNS proxies across the Internet (which answer questions about how machine names like www.freedom-to-tinker.com related to IP addresses like 209.20.73.44). This amplifies traffic because the bots can send a small query that elicits a large response message from the proxy.

Here is our second externality: the existence of open DNS proxies that will respond to requests from anywhere on the Internet. Many organizations run DNS proxies for use by their own people. A well-managed DNS proxy is supposed to check that requests are coming from within the same organization; but many proxies fail to check this—they’re “open” and will respond to requests from anywhere. This can lead to trouble, but the resulting harm falls mostly on people outside the organization (e.g. Spamhaus) so there isn’t much incentive to take even simple steps to prevent it.

To complete the attack, the DNS requests were sent with false return addresses, saying that the queries had come from Spamhaus—which causes the DNS proxies to direct their large response messages to Spamhaus.

Here is our third externality: the failure to detect packets with forged return addresses. When a packet with a false return address is injected, it’s fairly easy for the originating network to detect this: if a packet comes from inside your organization, but it has a return address that is outside your organization, then the return address must be forged and the packet should be discarded. But many networks fail to check this. This causes harm but—you guessed it—the harm falls outside the organization, so there isn’t much incentive to check. And indeed, this kind of packet filtering has long been considered a best practice but many networks still fail to do it.

I’ve been writing about security externalities for years. They’re often much harder to solve than technical problems.

By the way, a lot of the hype surrounding this attack was media manipulation.
